Terms of Service

These terms govern your use of Drop Monthly as somebody who runs a brand on it. By creating an account you agree to them. If you are agreeing on behalf of a company, you confirm that you may bind that company, and "you" means the company. You must be at least 18 to hold an account.

If you are here because you joined a brand — its waitlist or its membership — these are not your terms. Yours are the membership terms.

The service

Drop Monthly is where a brand runs a membership built around a monthly drop. It gives you a public page for your brand, a waitlist, the tiers people pay to join, the list of who is a member this month, and the emails and texts that go with all of that.

You can also connect the systems that already know your customers — your store, your mailing list. You give us access to those systems; we read what you point us at and keep each source's record whole.

We may change how the service works. If a change removes something you rely on, we will tell you before it happens, through the app or by email to the address on your account.

Your account

You are responsible for what happens under your account, including what the people you invite do with it. Keep your credentials to yourself, use a second factor, and tell us promptly if you think somebody else has got in.

An organization has at least one owner. Owners control who else may join, what each member may do, and whether the organization requires single sign-on. If you are the last owner, you cannot remove yourself — hand the role over first.

Emails we send you

We send the emails the service cannot work without: confirming your address, resetting a password, a sign-in or security notice, an invitation to an organization, a receipt. These are sent whatever else you have chosen.

Notifications about what is happening in your organization are yours to turn off — from the link at the bottom of any of them, or in your settings.

Selling a membership here

A membership on your brand's page is sold by Drop Monthly on your behalf. We take the payment, through Stripe, and the member's agreement is with us, under the membership terms. How much of each sale is paid on to you, and when, is set by the plan or agreement you joined under.

What the membership is remains yours. You are responsible for what your page promises — that it is accurate, that you may lawfully sell it, and that what a member paid for is delivered when the page said it would be. If you cannot deliver a drop, tell us and tell your members before the date, not after.

Emails and texts you send

Drop Monthly sends email and text messages to the people your brand knows. The rules here are the ones the law and the mail and mobile networks hold us to, so they are not negotiable, and the app enforces most of them for you.

  • Only to people who agreed. A marketing message goes to somebody only if they said yes to that channel — email and texts are separate choices, each recorded with when and where it was made. Somebody who joined a waitlist has not agreed to marketing by doing so.
  • No bought, rented, scraped or borrowed lists. Contacts you import or connect must be people who gave your brand their address and agreed to hear from it. If we ask how an address was collected, you must be able to show us.
  • Every marketing email carries a working unsubscribe link, and every text answers STOP. We honour both immediately and automatically. You may not remove them, hide them, or message somebody again after they have used one.
  • Say who you are. A message must name the brand it is from, must not disguise its sender or its subject, and must carry a postal address where the law requires one.
  • Receipts and messages about a person's own membership are not marketing. They are sent whatever the person chose, and may not be used to carry an advertisement.

We stop sending to an address that bounces or that reports a message as spam. If your messages draw complaints or bounces at a rate that puts our sending at risk, we may pause your sending while we work out why with you.

Your data stays yours

Everything you connect, upload or create in Drop Monthly belongs to you. We store it, process it and show it back to you so the service works, and we do not sell it, rent it, or use it to train anything.

You can export what we hold at any time. If you close your account we delete your data within 30 days, except records we are required to keep — including the record that you accepted these terms, and the records of payments members made to us.

We hold the contacts you connect or import on your behalf. If the people in them have rights over that information under the law where they live, honouring those rights is your responsibility, and we will help you do it. People who join your brand here are different — we hold their details as the seller as well as for you. See our privacy policy for how we handle personal information.

What you may not do

Do not use Drop Monthly to break the law, to send messages the recipient did not ask for, or to build a profile of somebody who has told you to stop. Do not sell anything it is illegal to sell or to ship, and do not mislead people about what they are buying, what it costs, or how to cancel it. Do not attempt to reach another customer's data, disrupt the service for others, or work around the limits of your plan.

We will suspend an account that is doing any of these, and we will tell you why.

Paying for it

Paid plans bill in advance, monthly or yearly, and renew automatically until cancelled. Seats are counted by the number of people in your organization; add somebody mid-period and the charge is prorated.

Cancel whenever you like — your plan runs to the end of the period you have paid for, and we do not refund the remainder. If a payment fails we will retry it and tell you; if it keeps failing we may suspend the account until it is settled.

Prices can change. We will give you at least 30 days' notice before a change affects you, and it never applies to a period you have already paid for.

Availability

We work hard to keep Drop Monthly up and we do not promise it always will be. Things break, providers go down, and maintenance sometimes has to happen during your working day. We will tell you about planned interruptions in advance.

The service is provided as it is. To the extent the law allows, we make no warranties about it, and our liability to you is limited to what you paid us in the twelve months before whatever went wrong.

Ending it

You can close your organization at any time from its settings. We can end your access if you break these terms, if we are required to, or if we stop offering the service — and in the last case we will give you reasonable notice and time to get your data out.

Changes to these terms

We may update these terms. When we do, we publish a new version and ask you to accept it the next time you sign in. Continuing to use Drop Monthly after that means you agree to the new version. Every version you have accepted is recorded with the date you accepted it.
